Buyer/Owner Inspection Agreement

Upon completion and delivery to the Buyer/Owner of a ‘HomeGauge’ computer generated inspection report the Buyer/Owner agrees to pay to Florida Healthy Home Inspections the sum of: ________________________________________________________________________
The Buyer/Owner further agrees to the following:
The inspection is limited to the visual observations of apparent conditions existing at the time of inspection. When necessary the inspector will perform simple operating tests to determine when equipment or appliances are working properly.
The inspection is performed and report generated for the confidential and sole use of the Buyer/Owner or their representative. If the inspector recommends consultation by a specialized expert the consultation will be the Buyer/Owner’s option and expense.
The inspection report does not imply or express a warranty on any items inspected unless otherwise noted by another agreement. Concealed deficiencies or defects whether noted or not noted are excluded from this inspection. The inspector is not required to move furniture, debris, storage boxes, equipment, floor coverings, other items or where there is less than 30” head room which may limit or conceal access to any area.
The inspector will not report on any cosmetic or aesthetic defects which may include but not limited to painting, foggy window panes, scratches, and nail holes, defective or worn carpet. Furthermore, cracks in ceilings, walls, slabs, paving, etc. that are considered minor and have no bearing on the structural integrity of the property will not be reported.
The inspection is not a substitute to replace any real property disclosure statements required by law, nor does it substitute or replace any obligation of the Buyer/Owner.
Florida Healthy Home Inspections or its employees have no present or contemplated future interest in the property contracted to be inspected.
The inspection is performed in compliance with accepted standards of practice and performance and conforms or exceeds the standard established by the Florida Association of Building Inspectors and the National Association of Certified Home Inspectors.
The Buyer/Owner and/or their representative understand and agree that Florida Healthy Home Inspections and its employees or agents assume no liability or responsibility for the costs of repairing or replacing any reported or not reported defects or deficiencies whether present or arising in the future, or any property damage, consequential damage, or bodily injury of any nature. If the repairs or replacement is done without sufficient notice to the inspector, the inspector will have no liability to the Buyer/Owner. The Buyer/Owner further agrees that Florida Healthy Home Inspections is liable only to the cost of the inspection.
Any dispute, controversy, interpretations or claim including claims for, but not limited to, breach of contract, any form of negligence, fraud or misrepresentation arising out of, from or related to, this contract or related to the inspection or inspection report shall be submitted to final and binding arbitration under the Rules and Procedures of the Expedited Arbitration of Home Inspection Disputes of Construction Arbitration Services, Inc. The decision of the Arbitrator appointed there under shall be final and binding judgment on the Award and may be entered in any Court of competent jurisdiction.
This constitutes the entire agreement between Florida Healthy Home Inspections and the Buyer/Owner or their representative and witness whereof execute this agreement.
